Terms and Conditions
These Terms and Conditions constitute a contract between you and OFFICE COFFEE sp. z o.o. based in 50-201 Wrocław, Mieszczńska 25/88, VAT ID: PL9151816164 (“us,” “we,” “I,” “me,” etc.) and set forth the terms and conditions of contracts entered into through our website available at. https://www.office-coffee.pl.
Every customer or user of our Website, Online Store, or services (including the newsletter service) is required to read and accept our Terms and Conditions before using the functionality of our website or entering into any other contract with us. If you do not accept these terms, you should leave our Website immediately.

1. Definitions
The definitions used in these Terms and Conditions should be understood as follows:
● Customer – An individual with full legal capacity, a company, or other legal entity who uses the services and functionalities of the Website, and in particular, makes purchases through the Store.
● User – A natural person with full legal capacity who subscribes to the Newsletter or uses Digital Services, thereby entering into an Agreement with us.
● Consumer – A natural person making a purchase on the Website or using a free digital service offered by us, not directly related to their economic or professional activity.
● Website – The Internet service operated by us, available at the following address: https://www.office-coffee.pl.
● Store – The online store operated by us at the following Internet address: https://www.office-coffee.pl.
● Digital Product – Digital content available in our store, produced and delivered in digital form, recorded on an intangible medium (e.g., downloadable ebook, access to an online course), which is the subject of the Contract between you and us.
● Digital Service – A service that allows you to store and access data in digital form or interact through digital data (e.g., Store account service).
● Consultation – A service provided by us, which is an online meeting or a telephone call.
● Goods – A physical product available in our online store.
● Newsletter – Digital content delivered to persons who have subscribed via the subscription form on the Website. The Newsletter content also includes the so-called lead magnet (gift for signing up), which is delivered to the User once after signing up for the Newsletter.
● Digital Environment – Computer hardware, software, and network connections used by you to make a purchase from the Store, to access the content and/or digital service you purchased, or to access a free digital service or Newsletter.
● Shopping Cart – An element of our store’s software in which selected Goods and Digital Products and Services for purchase are visible, and where it is possible to establish and modify the Order data.
● Order Form – A form available in the Store that allows you to place an Order, particularly by adding Goods and Digital Products and Services to an electronic shopping cart and specifying the terms of the Contract concluded remotely, including the method of delivery and payment.
● Newsletter Subscription Form – A form available on the Website that allows the conclusion of a contract for the delivery of the Newsletter.
● Registration Form – A form available on the Store that allows you to create a Client’s Account.
● Client’s Account – An account in the Store, which you may or may not create, where the data provided by you and information about Orders placed by you in the Store are collected.
● Opinion Form – A form available on the Website that allows the User to post feedback about Products and Services.
● User Content – Data and information provided by you on the Website or Store.
● Unauthorized Content – Content that violates the provisions of applicable law, good morals, or is otherwise inconsistent with the provisions of the Terms and Conditions.
● Order – Your statement of intent made via the Order Form and aimed directly at concluding the Contract.
● Payment Processor – The company that handles our store’s payments. Processor’s details: Stripe, Inc. or Stripe Payments Europe, Limited.
● Contract – A contract concluded at a distance with you through an organized system of concluding contracts at a distance (e.g., Store or Website).
● Terms and Conditions – These terms and conditions.
2. Customer’s Digital Environment
2.1. In order to use the Website and the Store, including browsing our assortment, placing orders, and using the Goods, Digital Products, or Services and Consultations, the following are required:
● A device with access to the Internet, an operating system, and a web browser that allows you to browse the Internet.
● A browser for PDF, Word, and Excel files
● An active email address.
● For some Digital Products and Services (e.g., live webinars, online consultations), it may be required to install additional software or use an external application (e.g., Zoom or other applications for webinars and online meetings), of which we will inform you prior to purchase by including this information in the description of the Digital Product or Digital Service.
2.2. We shall take technical and organizational measures to provide you with secure access to our Website and Store and use of Products, Digital Services, and Consultations, particularly measures to prevent access and modification of personal data by unauthorized persons.
2.3. You are prohibited from providing unlawful content.
2.4. We are entitled to technical interruptions in the operation of the Website, including the Store, necessary for planned, ongoing operation and maintenance of the server and software. In the event of a planned interruption, we will clearly notify you about it on our Website.
2.5. To the fullest extent permitted by law, we shall not be liable for disruptions, including interruptions in the functioning of the Website and the Store caused by force majeure, unauthorized acts of third parties, or incompatibility with the computer hardware or software used by you.
3. Newsletter
3.1. Through the Website, we allow you to sign up for the Newsletter. The terms and conditions of the Newsletter service are described on our Website.
3.2. To receive the Newsletter, follow these steps:
● Fill out the Newsletter Subscription Form.
● Consent to the processing of data for the purpose of sending the Newsletter covering direct marketing of our digital products and services.
● Read and accept these Terms and Conditions and subscribe by clicking the „[Subscribe]” button.
● Find the email we send to the address provided in the Newsletter Subscription Form and click the „[Confirm the Newsletter sign-up]” button.
3.3. The first Newsletter, possibly including a gift for signing up, will be delivered to you immediately after completing the steps specified above. Subsequent Newsletters will be delivered by us at the frequency specified in the description of the Newsletters on our Website.
3.4. The Newsletter is provided for an indefinite period and may be terminated at any time with immediate effect. You can terminate the Newsletter by unsubscribing according to the instructions in each Newsletter or by sending a request to our email address or in writing to the address provided in the Terms and Conditions.
4. Digital Services and Rules for Moderating User Content.
4.1. We enable the following digital services through our Website and Store:
● Accessing and browsing the free content and assortment on the Website and Store and using the available content search engine.
● Enabling you to place an Order in the Store with and without registration.
● Creating and maintaining a Customer’s Account in the Store.
● Accessing and viewing paid digital content e.g., online courses, training materials, etc.
● Posting User Content in the Store or on the Website, including:
○ Opinions on purchased Physical and Digital Products and Consultations.
○ Posts in groups on social media administered by us, such as Facebook or Instagram.
○ Comments under lessons in our online courses visible to other learners.
4.2. Digital Services Agreements are concluded for an indefinite period and may be terminated at any time with immediate effect. You can terminate the Client’s Account by deleting the Account after logging in or by sending a request to us at the email address provided in the Terms of Service. You can cancel the remaining services by ceasing to use them.
4.3. We are entitled to moderate User Content, i.e., to take action to detect and identify unauthorized content and to combat it, including removing it or preventing other Users from accessing it.
4.4. We may moderate User Content on our own initiative or as a result of reports by other Users or third parties who consider the reported content to be illegal or otherwise not in compliance with the Terms of Use.
4.5. We may moderate User Content also at the stage of its publication on the Website or in the Store, but we are not obliged to do so.
4.6. We consider prohibited content to be content that violates the provisions of applicable law, decency, or is inconsistent with the provisions of the Regulations, in particular content that:
● Violates the personal rights of third parties, intellectual property rights, data protection laws, or company secrets
● Incites or praises hatred, discrimination, or violence against individuals or groups, including but not limited to race, gender, sexual orientation, religion or lack thereof, worldview, nationality, or disability
● Contains pornography or other forms of sexual exploitation
● Incites violence against people or animals
● Praises or incites terrorist activities
● Aims at or supports fraud or scamming
● May mislead or harm the public (disinformation and so-called „fake news”)
● Evokes negative emotions in the recipient or promotes behavior dangerous to health and life
● Does not relate to the subject matter of the commented content
● Contains vulgarisms or content generally considered offensive
● Is intended to promote services or products offered by third parties or by the person posting the content
● Has the character of spam
● Contains links
4.7. If you consider User Content to be illegal or in violation of the Terms and Conditions (Unauthorized Content), you may report such content to us for moderation. Send your report to our Point of Contact.
4.8. The notification must contain all of the following:
● A sufficiently reasoned explanation of why you consider the reported content to be illegal or otherwise not in compliance with the Terms of Service
● A clear indication of the exact electronic location of the reported content, such as the exact URL(s), and, if applicable, additional information to identify the reported content
● Your name and surname or name and email address (this does not apply to a report of information believed to be related to one of the crimes of sexual abuse and sexual exploitation of children and child pornography – for such crimes the report may be anonymous)
● Your statement that the information and allegations contained therein are correct and complete
4.9. In the case of an incomplete or erroneous application, we will call you to complete the deficiencies within 14 days of receipt of the application and make an instruction that failure to complete the deficiencies in the specified period will leave the application unprocessed.
4.10. Upon receipt of a complete application, we will immediately confirm to you the receipt of your application at the email address provided in the application.
4.11. We will consider the application no later than 14 days from the date of receipt of a complete application. In order to moderate the submitted content, we may require you to provide additional information and/or documents necessary for verification.
4.12. For the duration of moderation of the reported content, we may block the visibility of the reported content to other Users.
4.13. We moderate content in good faith and exercise due diligence, i.e., in an objective, non-discriminatory, and proportionate manner:
● Evaluate it for compliance with the law and the terms of the Regulations.
● Make a decision to remove it, prevent other Users from accessing it, limit its visibility, suspend or terminate the digital service, suspend or terminate the User’s account, or not to violate the Terms and Conditions.
4.14. In the event that we acquire any information giving rise to a suspicion that a crime endangering the life or safety of a person or persons has been committed, is being committed, or may quite possibly be committed, we shall immediately inform the relevant law enforcement authorities of our suspicion.
4.15. We will immediately notify you and the User who posted the reported content of our decision to notify law enforcement authorities. The notification does not apply if the User’s content is misleading commercial content.
4.16. Appeals against our decision can be submitted to our Point of Contact.
4.17. The appeal should include the name (or entity name) and contact information of the person submitting the appeal and the reasons why the decision is disputed, the scope of the request, and an indication of the arguments justifying the request.
4.18. We will consider the appeal within 14 days from the date of submission of the appeal. We will process appeals without the involvement of automated decision-making systems.
5. DSA Single Point of Contact
5.1. In accordance with Digital Services Act we have designated a point of contact for direct communication – electronically – with the European Union authorities including the Commission and the Board of Digital Services, as well as for contacting Users and third parties.

6. Paid Digital Products, Services and Consultations
6.1. Through the Store, we allow you to order digital content not stored on a tangible medium (Digital Products and Services). This means that this content is made available as electronic files to be played or downloaded, depending on the Digital Product or Service you choose (e.g., ebook, webinar, online course). We provide detailed descriptions, including functionalities of Digital Products and Services in their descriptions on the Website and/or the Store.
6.2. In the case of Digital Products and Services to which access is granted for a limited period of time, we provide access to them for the time indicated in the description of the Digital Product or Service.
6.3. In the case of Digital Products and Services that we offer for pre-sale, we provide access to them for the periods indicated in their descriptions made available on the Website.
6.4. Through the Store, we also allow the conclusion of an agreement for an online Consultation. We specify the details of the Consultation, including its scope and duration, in the description of the Consultation provided on the Website and the Store.
7. How to Create the Client’s Account in the Store
7.1. Setting up an Account in the Store is free of charge.
7.2. To set up an Account in the Store, fill out the Registration Form or mark the appropriate checkbox when placing an order in the Store.
7.3. You can log into your account using the login and password provided to you by us.
7.4. You may delete your account at any time, without giving any reason and without incurring any fees for doing so. You can do it using the functionality of the Account or by sending an appropriate request to our email address or in writing to the address provided in the Terms and Conditions.
8. Consultations and Other 1:1 Services
8.1. Consultations and other 1:1 services are provided in Polish or English.
8.2. Consultations and other 1:1 services are provided on business days designated by us using the calendar provided on our Website.
8.3. Your unexcused absence from the confirmed date of access to a Digital Product, Digital Service, or the confirmed date of a Consultation or other 1:1 service shall not entitle you to non-payment of the Order or to a refund of the payment if you have previously made it. This does not apply if the Customer, who is a Consumer, has effectively withdrawn from the Contract or if there has been an effective termination of the Contract.
9. How to Place an Order in the Store
9.1. You can place an Order in the Store 24 hours a day, on all days of the year.
9.2. To place an Order:
● Select a Product, Digital Product, or Consultation and then click the „Add to Cart” button.
● Go to the shopping cart and click „Go to payment”.
● If you want to make a purchase through your Client’s Account, log in to it and check your data
● If you order without using the Client’s Account, fill in the Order Form, entering your data and the address to which we should send the product.
● If you are ordering a physical product, also select the method of delivery of the Goods.
● Select one of the available payment methods.
● Accept the Terms and Conditions.
● If you are ordering a Digital Product, expressly agree to deliver the Digital Product or perform a Consultation under circumstances that cause you to lose your right of withdrawal.
● Click the „Buy and Pay” button.
● Make payment. Payment is made directly on the Payment Processor’s website.
● After payment is made, you will be redirected back to our Website.
9.3. Once you place an order using the „Buy and Pay” button, a Contract will be concluded between you and us.
9.4. After placing an order, we will send you an email confirmation of the conclusion of the Contract, a confirmation of receipt of your consent to the delivery of digital content in circumstances that cause you to lose your right of withdrawal, and a copy of these Terms and Conditions to the email address you provided.
10. Prices and Offered Delivery and Payment Methods
10.1. Prices:
● The prices of Goods, Digital Products, and are specified in their descriptions available on the Website and in the Store.
● All prices on the Website and the Store are gross prices and already include taxes.
● We may apply individual price adjustment based on automated decision-making.
● The price shown next to Goods, Digital Product, or Consultation at the time you place an order is binding.
● The price for the Digital Product or Consultation is the total amount to be paid by you. We inform you about it before placing the Order.
10.2. Delivery:
● Delivery of Goods shall be made no later than 30 working days or shorter if such is indicated in the product description. In the case of pre-sales, Goods will be delivered within the period indicated in the product description made available on the Website.
● In the case of ordering Goods, the total amount to be paid consists of the price for the Goods and the cost of delivery, which we inform you about before you place your order.
● You may use various methods of delivery or collection of the ordered Goods. We provide you with a list of available options in the Order Form.
● There are no delivery costs associated with the delivery of a Digital Product or a Digital Service.
● We will send you information about access to Digital Products and Digital Services to the email address you provided.
10.3. Payment:
● You can pay for your order by choosing one of the available payment methods. We provide a list of payment methods in the Order Form before you place your order.
● By placing an Order, you agree that we may send invoices or payment confirmations and any corrections thereof electronically to the email address you provide in the Order Form.
11. Deadline for Delivery of Digital Products and Services
11.1. Digital Products and Digital Services shall be delivered immediately after the conclusion of the Contract. In case the Digital Product and/or Digital Service is to be delivered at a later date (pre-sale), we shall expressly inform about it in the description of the Digital Product/Service on the Website or in the Store.
11.2. The Digital Product shall be deemed to have been delivered when it was made available to you as an attachment to the email we sent you after you placed and paid for your order, or as information about the login details of the platform from which you can download the Digital Product. The Digital Service is considered to have been delivered when you access it.
12. Complaints (Liability for Non-Conformity of Performance with the Contract)
12.1. We are obliged to provide you with Goods, Content, or Digital Services in accordance with the Contract (so-called consumer warranty).
12.2. If you find a non-conformity with the Contract, inform us about it, specifying your demands related to the found non-conformity (filing a complaint).
12.3. You may submit a complaint in writing or by email to our address.
12.4. The complaint should contain your identifying information, a description of what the complaint concerns, and the demands related to it. If the information is incomplete, we will ask you to complete it within 14 days. Remember that if you do not complete the deficiencies within the indicated period, we will not be able to handle your complaint.
12.5. We will process your complaint within 14 days from the date of its submission, unless the law of your country of residence provides for a shorter period.
13. Right of Withdrawal from the Contract
13.1. If you have placed an order in our store as a Consumer, you may withdraw from the Contract without giving any reason. To comply with the deadline for withdrawal, it is sufficient for you to send us a notice that you are withdrawing from the contract before the expiration of 14 days, unless the law of your country of residence provides for a longer period. This period is calculated:
● In the case of Goods, from the date of transfer of the Goods to you or a person designated by you, other than the carrier you have chosen to make the delivery.
● In the case of Digital Products and Services, from the moment we provide you with information about access to the digital product or service.
13.2. The right to withdraw from a contract concluded at a distance does not apply to certain contracts. These are:
● Contracts for the provision of paid services, if, with your consent, we perform the service before the expiration of the withdrawal period, and you confirm that you have acknowledged that you will lose the right to withdraw from the service after the performance of the service.
● Contracts whose object of performance is goods that are not prefabricated or manufactured to your specifications, or that serve to meet your individualized needs.
● Contracts whose object of performance is goods that deteriorate quickly or have a short shelf life.
● Contracts in which the object of performance is goods delivered in a sealed package that cannot be returned after opening the package for health or hygiene reasons, if the package has been opened after delivery.
● Contracts whose object of performance is things which, after delivery, by their nature, become inseparably connected with other things.
● Contracts whose object of performance is sound or visual recordings or computer programs delivered in sealed packaging if the packaging has been opened after delivery.
● Contracts for the provision of digital content for a fee (Digital Products), if you have already received access to it, to which you have previously agreed and confirmed that you accept the loss of the right of withdrawal after the delivery of digital content.
13.3. To withdraw from a contract that does not involve the situations listed in the previous paragraph, inform us of your intention to withdraw from the contract. You can notify us at our email address or in writing to our mailing address. You may use the template in the appendix below these Terms and Conditions for this purpose. However, it is not mandatory.
13.4. In case of withdrawal from the Contract, we will return the payments received from you no later than 14 days from the day on which you inform us about the withdrawal from the Contract. We will refund the payment using the same payment methods you used for the purchase, unless you request a refund in another form. We have the right to withhold the refund until we receive the Goods returned by you or confirm that you have returned them to us (whichever is earlier).
13.5. You will be responsible for the direct costs of returning the Goods, including the cost of packaging and returning the goods to our address.
13.6. Return the goods to us in the same condition as you received them. Remember that you are liable for any diminution in the value of the Goods resulting from the use of the product beyond what is necessary to ascertain the nature, characteristics, and functioning of the Product.
13.7. If you withdraw from a contract for the provision of content or a Digital Service, you are obliged to stop using the content or Digital Service and to cease making it available to third parties.
14. Out-of-court ways to resolve consumer disputes
14.1. In case of disputes arising from concluded distance agreements, we strive to resolve them amicably. If our attempts at amicable resolution fail, the case will be brought before the competent court. For customers not entitled to consumer protection, disputes related to such contracts will be handled by the court with jurisdiction over our registered office.
14.2. If you are entitled to consumer protection and reside in the European Union, you have access to alternative dispute resolution methods outside the court system, including:
● Consumer Court: You can apply to a consumer court to settle a dispute arising from a contract.
● Mediation: You may request local competent inspectors to initiate mediation proceedings for an amicable settlement of the dispute.
● Consumer Ombudsman or Social Organization: You can seek assistance from a consumer ombudsman or a social organization in your country of residence, which is tasked with consumer protection.
● EU ODR Platform: You can also file a complaint through the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/. (This option does not apply to consumers residing in the UK).
15. Copyright
15.1. The digital content available on the Website, including materials within Digital Products and Digital Services, are protected by copyright owned by us or by persons cooperating with us under relevant licenses.
15.2. You may use purchased Digital Products and other content available on the Website for permitted private use only. This means you may use them solely for your own purposes, including business, provided you do not make them available to third parties as your own product or service, whether for fee or free of charge.
15.3. Unauthorized distribution of the above content may result in civil and criminal liability.
16. Personal Data and Cookies
The rules for processing personal data and the use of cookies are described in our Privacy and Cookies Policy available at the URL: https://www.office-coffee.pl/privacy
17. Final Provisions
17.1. We reserve the right to amend these Terms and Conditions for important reasons, including changes in laws, regulations, or changes affecting our services, including payment and delivery methods.
17.2. We will inform you of any planned changes by publishing them on our Website and, if applicable, by email to the address provided in your order. Amendments take effect from the date of publication on the Website, except for contracts already concluded, where changes are effective no earlier than 14 days from the date of notification.
17.3. If changes materially affect your rights under a concluded Agreement, you have the right to terminate the Agreement within 14 days from the date of notification. Failure to terminate signifies acceptance of the amended Terms and Conditions.
17.4. For matters not covered by these Regulations, the generally applicable provisions of Polish law apply, preserving your rights as a Consumer under mandatory laws of your country of residence.
17.5. These Regulations apply to agreements concluded from 08.08.2024.

Niniejsze Warunki i Postanowienia stanowią umowę zawieraną między użytkownikiem a spółką OFFICE COFFEE sp. z o.o. z siedzibą we Wrocławiu, przy ul. Mieszczńskiej 25/88, NIP: PL9151816164, KRS: 0000848636, REGON: 386472286 („my”, „nas”) i określają warunki korzystania ze strony internetowej dostępnej pod adresem https://www.office-coffee.pl oraz zakupu towarów w naszym Sklepie Online.

1. Postanowienia Ogólne
1.1. Niniejszy Regulamin określa zasady korzystania ze Strony Internetowej oraz warunki składania zamówień i zawierania umów sprzedaży na odległość dotyczących wyłącznie towarów materialnych.
1.2. Wszelkie zamówienia składane za pośrednictwem Sklepu są zawierane na podstawie niniejszego Regulaminu.
2. Definicje
Dla celów niniejszego Regulaminu przyjmujemy następujące definicje:
– Klient – osoba fizyczna (z pełną zdolnością do czynności prawnych), przedsiębiorca lub inny podmiot, który dokonuje zakupu towarów.
– Użytkownik – osoba korzystająca ze Strony Internetowej (m.in. subskrybująca Newsletter).
– Konsument – osoba fizyczna dokonująca zakupu w Sklepie, niezwiązana bezpośrednio z działalnością gospodarczą lub zawodową.
– Strona Internetowa – serwis internetowy prowadzony przez nas, dostępny pod adresem https://www.office-coffee.pl.
– Sklep – internetowa platforma sprzedażowa dostępna pod adresem https://www.office-coffee.pl.
– Towar – fizyczny produkt dostępny w naszym Sklepie.
– Newsletter – bezpłatna usługa polegająca na wysyłce informacji handlowych i promocyjnych drogą elektroniczną, do której subskrypcji zachęcamy za pomocą formularza dostępnego na Stronie.
– Koszyk Zakupów – funkcjonalność Sklepu umożliwiająca wybór towarów przed złożeniem zamówienia.
– Formularz Zamówienia – elektroniczny formularz umożliwiający złożenie zamówienia na towary.
– Formularz Rejestracyjny – formularz umożliwiający utworzenie Konta Klienta w Sklepie.
– Konto Klienta – profil użytkownika, w którym gromadzone są dane osobowe oraz informacje o dokonanych zamówieniach.
– Treść Użytkownika – wszelkie dane i informacje przesyłane przez użytkowników (m.in. opinie lub komentarze).
– Procesor Płatności – podmiot obsługujący płatności, np. Stripe, Inc. lub Stripe Payments Europe, Limited.
– Umowa – umowa sprzedaży zawierana na odległość pomiędzy Klientem a nami, skutkująca złożeniem zamówienia.

3. Wymagania Techniczne
3.1. Do korzystania z naszej Strony i Sklepu wymagane jest:
• Urządzenie z dostępem do Internetu oraz aktualną przeglądarką.
• Aktywny adres e-mail.
